Grease Waste

New Grease Waste Requirements Effective July 1, 2022

Beginning July 1, 2022, a copy of the signed, completed service manifest must be retained on-site by the grease waste originator and the grease waste hauler for one year. The service manifest documents the removal and disposal of grease waste.

Overview 

Senate Bill 1110 passed in the 2022 Florida legislative session and published in the Laws of Florida 2022-095 creating section 403.0741, Florida Statutes. The new law requires grease waste haulers to dispose of grease waste, including grease waste from grease interceptors, traps and graywater, at disposal facilities and to document grease waste removal and disposal with service manifests. 

Additionally, an inspecting entity will verify contracts with the hauler for the grease waste removal, and periodic inspections will be performed to review contracts service manifests. Local governments are authorized to regulate grease waste removal and disposal. The Florida Department of Environmental Protection will adopt rules. 

  • A hauler is a person who removes and disposes of grease waste. 
  • An originator is a food service establishment that processes, prepares or serves food or beverages for consumption by the public, including, but not limited to, restaurants, commercial kitchens, cafeterias, hotels, school kitchens, hospitals, prisons, correctional facilities and care institutions.
  • A disposal facility is a permitted or certified waste management facility that is authorized to receive grease waste. 

Responsibilities

Originator
  • Upon completion of grease waste removal, sign the service manifest verifying that the information is accurate. 
  • Retain a copy of the service manifest on-site for one year.
Hauler
  • Document the removal and disposal of grease waste with a service manifest.
  • Verify information is accurate with the originator and the disposal facility operator and sign the service manifest.
  • Provide a copy of the signed service manifest to the originator.
  • Upon completion of grease waste disposal, sign the service manifest verifying that the information is accurate. 
  • Provide the originator and the county and municipality in which the originator is located with a copy of the completed service manifest showing the signatures of the originator, the hauler and the disposal facility operator within 30 days after the date of the disposal.
Disposal Facility
  • Upon completion of grease waste disposal, sign the service manifest verifying that the information is accurate. 

Service Manifest

The service manifest must have an originator section, hauler section and disposal facility section that includes the name address and telephone number for each. The service manifest must also contain the following information:

  • The condition of the originator’s grease interceptor or grease trap.
  • Verification that the grease interceptor or grease trap was cleaned by the hauler and that graywater was not returned to the grease interceptor or grease trap.
  • The amount of grease waste removed from the originator’s grease interceptor or grease trap.
  • The amount of grease waste disposed of at the disposal facility.
  • The billing receipt or ticket number provided to the hauler by the disposal facility.

Additional Information

A hauler who violates section 403.0741, F.S., is subject to penalties as stated in the statute. Local governments are authorized to regulate grease waste removal and disposal. Haulers are responsible for complying with appropriate local ordinances, laws or rules.

DEP will begin rulemaking to implement this section of law.
