Financial assurance is required for qualifying Underground Storage Tanks (USTs) and Aboveground Storage Tanks (ASTs). Financial responsibility rules for petroleum storage tanks were revised in 2017 to require financial institutions to use DEP forms when providing financial assurance to tank owners.
Another Rulemaking process has been completed. While no consequential changes were made to the forms, they were changed slightly, and these new forms will need to be used. The current form effective date is June 2023.
Links to selected portions of DEP rules cover most of the financial assurance and cost estimate requirements for Hazardous Waste facilities as regulated by the Financial Assurance Working Group. Complete online versions of these DEP rules are available on the Division of Waste Management Rules page or the Florida Department of State's Florida Administrative Code.
