The revisions will conform the adoption by reference rule language to Department of State requirements, together with other corrective and clarifying amendments. DARM reviewed these rule sections as a component of the Department’s statutory rule review process and identified these rules as having outdated rule language and rule language updates necessary to meet new Administrative Procedures Act (APA) requirements. Revisions to Rule 62-213.205, F.A.C., will reflect recent amendments to Section 403.0872, F.S., which changed the emissions fee payment deadline to June 30 each year. Revisions to Rule 62-213.440, F.A.C., will restore certain affirmative defense provisions consistent with U.S. EPA compliance and enforcement policies applicable to major sources of air pollution under the Clean Air Act.
