Chapter 62-257, F.A.C., Florida’s Asbestos Program, Notice of Rule Development

The Division published a Notice of Rule Development (NORD) on May 7, 2024. The purpose of this NORD is to revise Rules 62-257.200 and 62-257.301, F.A.C., to update and revise definitions; delete unnecessary definitions, simplify the fee schedule; offer a discounted fee if electronic payment is made at the time of electronic notification submittal using the Department’s Business Portal; incorporate the updated Notice of Demolition or Asbestos Renovation Form; and make clarifying and corrective amendments consistent with 40 CFR Part 61, Subpart M, the National Emissions Standard for Asbestos. Rules 62-257.400 and 62-257.900, F.A.C., will be repealed as the revised form and simplified fee will be incorporated into Rule 62-257.301, F.A.C.  

The Division is proposing to revise Rule 62-257.301, F.A.C., to provide for a simplified, two-tiered fee structure. The two-tiered fee structure will provide for (1) a flat fee of $200 for any notification that generates a paper invoice (generated either though a paper notification or using DEP’s Business Portal); or (2) a discounted flat fee ($100) if the notification is filed and paid electronically using DEP’s Business Portal. These revisions in Rule 62-257.301, F.A.C., will allow the Division to repeal Rule 62-257.400, F.A.C., which contains the current fee schedule that varies the fee depending on the amount of regulated asbestos containing material being removed. This simplified fee structure will reduce costs for the owners or operators of asbestos removal projects
