Proposed Revision to 111(d) State Plan for CISWI

July 2, 2020, Proposed Revision to Florida's 111(d) State Plan for Commercial and Industrial Solid Waste Incineration Units (CISWI)

On July 2, 2020, the Florida Department of Environmental Protection (DEP) submitted, to the US Environmental Protection Agency (EPA), a proposed revision to Florida's previously-submitted CISWI State Plan to provide for an equivalent production-based particulate matter emission limit for units in the waste-burning kiln subcategory.  Florida also proposed a revision to CISWI State Plan to EPA on May 13, 2017, but is still awaiting EPA approval. May 31, 2017, Proposed Revision to Florida’s 111(d) State Plan for CISWI

On May 31, 2017, the DEP submitted, to EPA, a proposed revision to Florida's previously-submitted CISWI State Plan.  Florida's CISWI State Plan was submitted to EPA on February 6, 2014, as required by Section 111(d) of the federal Clean Air Act, and is still awaiting EPA approval. The May 31, 2017, submission includes EPA’s June 23, 2016, revisions to the model CISWI rules contained in 40 C.F.R. 60, Subpart DDDD and, pursuant to DEP’s authority under 40 C.F.R. 60.2515(b), includes a revision to provide for an equivalent production-based mercury emission limit for incinerators in the waste-burning kiln subcategory.
