Application Review and Approval Process

The Bureau of Public Land Administration manages the application process and coordinates review and approval with the Office of Environmental Services and the ARC. For more information you may visit the Bureau of Public Land Administration page or call the Division of State Lands at 850-245-2555.

Negative Response Requests

Incompatible use requests are posted on Thursdays for a two-week review period, except for State or Federal holidays. At the request of three or more ARC members, items on negative response may be placed on the next ARC agenda for review. Absent this request, the items are approved by delegated authority to the Division of State Lands.

Items Under Review:

Florida Power & Light Utility Easement: East Central Regional Trail

Florida Power & Light (FPL) has submitted a request for a 0.07-acre utility easement across a portion of the Brevard County East Central Regional Trail (Lease No. 4775). The easement will allow FPL to replace an aging wooden electrical pole with a concrete pole and guy wires. The existing pole location predates Board of Trustees' acquisition of the Trail. The following link contains the complete request with location maps and agency review letters:

The Division of State Lands will issue the easement to FPL unless three ARC members ask the Division to place the request on a future Council meeting agenda. The deadline for ARC to make this request is January 3, 2025. Please direct any question to Karen Reecy with the Division of State Lands at Karen.G.Reecy@FloridaDEP.gov.
