DEP proposes amendments in Chapter 62-550, Florida Administrative Code (F.A.C.), to update the chapter to be consistent with other Title 62 chapters, correct regulatory references, clarify current language and require electronic submittal of annual reuse reports through the business portal. 

These updates are included in Phase 2 of a two-phase rulemaking effort to adopt recommendations of the Potable Reuse Commission’s 2020 report “Advancing Potable Reuse in Florida: Framework for the Implementation of Potable Reuse in Florida” as required by Florida’s Clean Waterways Act of 2020.

DEP proposes amendments in Chapter 62-555, F.A.C., to update the chapter to be consistent with other Title 62 chapters, correct regulatory references, clarify current language and require electronic submittal of annual reuse reports through the business portal.

Chapter 62-565, F.A.C.,
Permitting, Construction, Operation and Maintenance of Advanced Treatment Water Facilities and Associated Systems.

Subsection 403.064(18), Florida Statutes (F.S.), authorized DEP to adopt rules for potable reuse based on the recommendations of the Potable Reuse Commission’s 2020 report “Advancing Potable Reuse in Florida: Framework for the Implementation of Potable Reuse in Florida.” Rules to implement potable reuse will address contaminants of emerging concern and ensure potable reuse water meets or exceeds federal and state drinking water quality standards.

As part of the development of rules regarding potable reuse as directed by the Legislature, DEP will create a new rule, Chapter 62-565, F.A.C., entitled “Permitting, Construction, Operation, and Maintenance of Advanced Treatment Water Facilities and Associated Systems."

Chapter 62-602, F.A.C., Water or Domestic Wastewater Treatment Plant Operators and Distribution System Operators.

DEP is proposing amendments to Chapter 62-602, F.A.C., to implement Chapter 2023-204, Laws of Florida, which amended sections 403.865 and 403.867, F.S., and created section 403.8721, F.S.

Chapter 2023-204, Laws of Florida, directed DEP to adopt rules for issuing licenses by reciprocity for water treatment, domestic wastewater treatment, and water distribution system operators with licenses from other states and individuals serving in the United States Armed Forces. Additionally, section 403.8721, F.S., authorizes DEP to issue temporary operator licenses during a declared state of emergency.
