Chapter 62-330, Florida Administrative Code (F.A.C.), Environmental Resource Permitting (ERP) Water Quality Enhancement Areas (WQEA). | Section 1, Chapter 2022-215, Laws of Florida (L.O.F.), directed DEP to adopt and modify rules adopted pursuant to Sections 373.4136 and 373.414, Florida Statute (F.S.), to establish a water quality credit trading program between WQEA facilities permitted under the ERP program and governmental entities. Rulemaking will also describe associated ERP requirements for the WQEA facilities and the governmental entities.

Chapter 62-620, F.A.C., Wastewater Facility and Activities Permitting. | DEP is initiating rulemaking to revise DEP Forms contained in Rule 62-620.910, F.A.C. Updated DEP Forms will be adopted and incorporated into Rules 62-620.100, .310, .325, .340, .410, .610, .620, .625, .630 and .910, F.A.C. These updates are part of DEP's current U.S. Environmental Protection Agency (EPA) and DEP Performance Plan Agreement, so that DEP Forms related to the National Pollutant Discharge Elimination System (NPDES) will include all data required on current EPA NPDES wastewater forms. DEP Form revisions will also include updates to provide consistency with revisions made to other DEP rules in recent years.

Chapter 62-620, F.A.C., Wastewater Facility and Activities Permitting. | DEP is proposing amendments to Chapters 62-620, 62-621 and 62-699, F.A.C., to clarify permitting procedures for Distributed Wastewater Treatment Systems (DWTS). DWTS are comprised of one or more small, onsite wastewater treatment units that can provide improved treatment over traditional OSTDS and have an improved capability for the multiple units of a DWTS to be remotely operated and maintained by a single, central wastewater utility entity. Chapter 62-621, F.A.C., Generic Permits. | DEP is authorized by the EPA to implement the NPDES program for surface water discharges from industrial wastewater facilities. Proposed rule amendments for Chapter 62-621, F.A.C., will adopt by reference EPA's NPDES Applications and Program Updates - Phase 1, under 40 Code of Federal Regulations (C.F.R.) 122.21, revised as of July 1, 2019. Additionally, application forms for industrial wastewater NPDES generic permits in Rule 62-621.300, F.A.C., will be updated to include applicable elements of EPA’s 2019 Form Update Rule and the 2015 Electronic Reporting Rule, including the 2020 amendments to the 2015 Rule.
