Other Forms Needed, Examples, and Links
- Period of Coverage will be from 'Guarantee made' date (from Part A page 1) to "evergreen".
- Form Part A (Financial Test) must be completed by the Guarantor.
- Form Part H (Standby Trust Fund) must be established in the name of the Owner or Operator.
- Example Certificate of Valid Claim - This is an option described in 40 CFR 280.112 for drawing on financial assurance mechanisms.

Guarantee Specific Guidance
- The "owner or operator" name identified on Part B (Guarantee) and on Part H (Standby Trust) needs to match name on Part P (Certification - C.F.R.).
- The Chief Financial Officer (CFO) may have a title different from "CFO", such as Comptroller, Vice President of Finance, Treasurer, etc.; but the CFO title is unlikely to include the word "assistant". Other individuals may have the authority to sign, but they will be able to produce documentation demonstrating their authorization.
What to Do with Completed Forms
- An owner or operator must maintain financial responsibility records (copies of the completed form parts with required supporting documentation) at the facility or at their business office.
- If not kept at the facility, they shall be made available at the facility or another agreed upon location upon five business days notice by a department or county inspector.
