The Asbestos Program

The Clean Air Act (CAA) requires the U.S. Environmental Protection Agency (EPA) to develop and enforce regulations to protect the public from exposure to airborne contaminants known to be hazardous to human health. In March 1971, EPA identified asbestos as a hazardous pollutant and promulgated the Asbestos National Emissions Standard for Hazardous Air Pollutants (NESHAP) in 40 CFR Part 61, Subpart M in April 1973. In 1982, EPA delegated primary authority for the implementation and enforcement of the Asbestos NESHAP to the state of Florida. The Florida Department of Environmental Protection (DEP) administers the asbestos program under Chapter 62- 257, Florida Administrative Code (F.A.C.). The Asbestos NESHAP has been adopted by reference in Rule 62-204.800, F.A.C.

The program’s intent is to minimize the release of asbestos fibers during activities involving the processing, handling and disposal of asbestos-containing material (ACM). Accordingly, the Asbestos NESHAP specifies work practices to be followed during demolitions and renovations of all structures, installations and buildings (excluding buildings that meet the residential exemption criteria in the Asbestos NESHAP). In addition, the regulations require the owner of the building and/or the operator to notify the applicable compliance office before any demolition or renovations of buildings subject to the Asbestos NESHAP.

Asbestos Notification Requirements

A Notice of Demolition or Asbestos Renovation must be submitted to the appropriate district or local program compliance office (see contact list below) for all demolitions or renovation projects involving the removal of ACM exceeding the thresholds identified in the Asbestos NESHAP at least 10 working days before the start date of the project using the form below.

Electronic Submissions of Notifications

To expedite the processing of asbestos project notifications, you may complete this form and pay associated project fees online in the DEP Business Portal. Please follow the steps below and utilize the Asbestos Electronic Notification Guide to assist in submitting your notice electronically.

Once logged into the DEP Business Portal, follow these steps:

  1. Click the Submit button.
  2. Click the Registration/Notification button.
  3. Click the Notification of Demolition or Asbestos Renovation button.

Follow the instructions on each screen to submit your notification. The Help tab at the top of each screen provides additional instructions to aid with your electronic submittal.

Note: If you do not have a login for the DEP Business Portal, create an account by clicking Register on the line just below the banner (left of Sign In), fill out the required information, and click the Register button at the bottom of the page. A verification email will be sent to your email address with a link. Use this link to create a password for your login. Unsubmitted Asbestos Notifications will be stored in the DEP Business Portal for up to 30 days. To continue working on an unsubmitted Asbestos Notification, click on the Continue option in the Portal's welcome page.

Electronic Payment of Asbestos Fees

You can also pay asbestos project fees online. You can either choose the Pay Now option after completing your online asbestos notification, or opt to have an invoice sent to you via email and pay later in the Business Portal using the Asbestos Notification ID.

Once logged into the DEP Business Portal, follow these steps:

  1. Click the Pay button.
  2. Click the Invoices button.
  3. Click the Asbestos Program Invoices button.
